These terms cover your use of rallydigital.co. Client projects are covered by a separate written agreement.
01Agreement to these terms
These Terms of Use ("Terms") apply to your use of rallydigital.co (the "Site"), operated by Rally Digital LLC ("Rally Digital," "we," "us"). By using the Site, you agree to these Terms. If you don't agree, please don't use the Site.
02Our services
The Site describes the marketing, website, advertising, email, SEO, video, podcast, and photography services we offer. Nothing on the Site is an offer to provide services. Any work we do for you is governed by a separate written proposal, statement of work, or services agreement. If that agreement conflicts with these Terms, the agreement controls.
Pricing, packages, and service descriptions on the Site may change without notice.
03Results and examples
Case studies, statistics, and examples on the Site show results from past or illustrative work. Every business is different. Results depend on many factors outside our control, including your market, offer, budget, competition, and the platforms we advertise on. We don't guarantee any specific outcome, such as leads, revenue, rankings, or return on ad spend.
Some figures on the Site may be examples meant to show how we report, and they're labeled that way where they appear.
04Free teardowns and consultations
Free audits, teardowns, and consultations are general recommendations based on the information available to us at the time. They aren't legal, financial, or tax advice, and you're responsible for decisions you make based on them.
05Intellectual property
The Site and its content, including text, design, graphics, logos, video, and code, are owned by Rally Digital or used with permission. They are protected by copyright, trademark, and other laws. You may view and share Site pages for personal or internal business use. You may not copy, reproduce, or reuse our content for commercial purposes without our written permission.
Client names, logos, and work shown on the Site belong to their respective owners and appear with permission for portfolio purposes. Their appearance doesn't mean those companies endorse Rally Digital beyond the work described.
06Acceptable use
When using the Site, you agree not to:
- break any law or infringe anyone's rights
- submit false information or impersonate anyone
- try to gain unauthorized access to the Site or its systems
- scrape, copy, or harvest Site content or data with automated tools
- introduce malware or interfere with how the Site works
07Things you send us
If you send us ideas, feedback, or materials through the Site, you confirm you have the right to share them. Ideas and feedback may be used to improve our services without any obligation to you. Materials you provide for client work are handled under your services agreement.
08Third-party links and tools
The Site may link to or embed third-party services such as YouTube, scheduling tools, and social platforms. We don't control those services and aren't responsible for their content, policies, or availability. Your use of them is subject to their own terms.
09Disclaimer
The Site is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't promise the Site will always be available, error-free, or secure.
10Limitation of liability
To the fullest extent the law allows, Rally Digital and its owners, employees, and contractors won't be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from your use of the Site. Our total liability for any claim related to the Site is limited to one hundred dollars (US $100).
11Indemnification
You agree to defend and hold harmless Rally Digital from claims, losses, and expenses, including reasonable attorneys' fees, that arise from your misuse of the Site or your violation of these Terms.
12Governing law
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-law rules. Any dispute related to the Site will be resolved in the state or federal courts located in Wake County, North Carolina, and you consent to their jurisdiction.
13Changes to these terms
We may update these Terms from time to time. Changes take effect when posted, and the "Last updated" date at the top will reflect the latest version. Continuing to use the Site after changes means you accept them.
